discrimination includes (I) the purchase or lease of an over-the-road bus which does not comply with the regulations issued under section 306 (a)(2)
by a
private entity which provides transportation of
individuals and which is not primarily engaged in the business of transporting people, and (II) any other failure of such entity to comply with such regulations.
