Employers are required by law to provide certain
records of your DOT
drug and alcohol testing history to your new employer, only when you sign a specific written release regarding that information.
(a) As an MRO or service agent you must provide, within 10 business days of receiving a written request from an employee, copies of any
records pertaining to the employee's use of
alcohol and / or
drugs, including
records of the employee's DOT - mandated
drug and / or
alcohol tests.

records of negative

and alcohol test results with a concentration of less than 0.02 for one year.

drug and alcohol testing for randomly selected DOT employees in safety or security sensitive positions.
(2) You must keep
records for three years of information obtained from previous employers under § 40.25 concerning
drug and alcohol test results of employees.
