No, as an employer, you must not require an employee to sign a consent, release, waiver of liability, or indemnification agreement with respect to any part of the
drug or
alcohol testing process covered by this part (including, but not limited to, collections, laboratory
testing, MRO
and SAP
services).
(2) The factual basis for the initiating official's belief that you are not providing
drug and / or
alcohol testing services to DOT - regulated employers consistent with the requirements of this part or are in serious noncompliance with a DOT agency
drug and alcohol regulation;
(b) This burden is to demonstrate, by a preponderance of the evidence, that the
service agent was in serious noncompliance with the requirements of this part for
drug and / or
alcohol testing - related
services or with the requirements of another DOT agency
drug and alcohol testing regulation.
(a) As an MRO or
service agent you must provide, within 10 business days of receiving a written request from an employee, copies of any records pertaining to the employee's use of
alcohol and / or
drugs, including records of the employee's DOT - mandated
drug and / or
alcohol tests.
You will also be subject to unannounced «Follow - Up»
testing for
drugs and / or
alcohol for at least 6 times during the first 12 months of active
service with the possibility of unannounced
testing for up to 60 months (as prescribed by the SAP).
Part 40 states: what specimens are collected; who performs the
drug and alcohol tests; how to conduct those
tests; what procedures to use when
testing,
and the mandatory return to duty requirements of an employee returning to safety - sensitive
service following a DOT
drug and / or
alcohol rule violation.
As a
service agent, you are subject to the following limitations concerning your activities in the DOT
drug and alcohol testing program.

service agent you may receive

test results.
(a) As a
service agent, the
services you provide to transportation employers must meet the requirements of this part
and the DOT agency
drug and alcohol testing regulations.
All
tests conducted using N's
services before September 1,
and through November 30, are valid for all purposes under DOT
drug and alcohol testing regulations, assuming they meet all other regulatory requirements.
(e) If the Director verifies that the sources of your noncompliance have been eliminated
and that all
drug or
alcohol testing - related
services you would provide to DOT - regulated employers will be consistent with the requirements of this part, the Director may issue a notice terminating or reducing the PIE.
As a
service agent, you may perform for employers the tasks needed to comply with DOT agency
drug and alcohol testing regulations, subject to the requirements
and limitations of this part.
(e) This section's prohibition on using the
services of a
service agent concerning which the Director has issued a PIE applies to employers in all industries subject to DOT
drug and alcohol testing regulations.
In an effort to educate the transportation industry
and others that provide
service in accordance with the Department's
drug and alcohol testing programs, our staff participates in conferences, trainings
and seminars throughout the country.
A
service agent who engages in serious misconduct could be excluded from participating in DOT - required
drug and alcohol testing for a period of time.
(c) All agreements
and arrangements, written or unwritten, between
and among employers
and service agents concerning the implementation of DOT
drug and alcohol testing requirements are deemed, as a matter of law, to require compliance with all applicable provisions of this part
and DOT agency
drug and alcohol testing regulations.
