In this section, I build upon these studies to elaborate the key features of a meaningful and
effective consultation process.

The features of a meaningful and
effective consultation process outlined in Text Box 1.4 were developed from the foundation of the government's commitments to Aboriginal and Torres Strait Islander peoples in the Declaration.
All governments in Australia should take heed of the features of a meaningful and
effective consultation process and use them to inform their approach to consultation and engagement with Aboriginal and Torres Strait Islander peoples in all areas that affect us.
In undertaking research for this section, I have asked Native Title Representative Bodies (NTRBs), Native Title Service Providers (NTSPs) and Prescribed Bodies Corporate (PBCs) to consider what to them would constitute a meaningful and
effective consultation process.
Given the unproductiveness of a prescriptive, tick - a-box approach, the features of a meaningful and
effective consultation process were prepared to guide the development of appropriate processes on a case - by - case basis.
In Chapter 3, I begin to outline the elements of a meaningful and
effective consultation process in relation to native title law and policy reform.
Let me illustrate, by discussing some features of a meaningful and
effective consultation process drawing on the spirit and intent of the UN Declaration on the Rights of Indigenous Peoples:

The
consultations highlighted critical issues for agreement making directed to economic and social development outcomes, including the need for:
effective community decision making structures and community engagement with the
process; adequate time and resources for capacity development; creative ideas for sustainable economic development; support for outcomes beyond the legal framework; positive relationships; and underlying infrastructure such as health, roads and education to be guaranteed by governments.
The development of the various protocols and
processes through
effective consultation and negotiation with Indigenous groups and relevant stakeholders ensures that land usage that affects native title groups can be managed to the advantage of all parties.

If governments intend to make changes to legislation that affects Indigenous land rights, they have a responsibility to ensure dissemination of information,
effective consultation and decision - making
processes involving Indigenous people.
Specifically, I explore the practical steps that governments can take to ensure that
consultation processes are meaningful and
effective.
In this section, I argue that the public
consultation process concerning the Amendment Bill (No 2) lacked many of the essential elements of a meaningful and
effective engagement
process.
It is on this basis, that I would argue that policy making
processes based on
consultation alone do not satisfy the principles of equality, equity and

These can be described as obligations of conduct and result (45) and include the

process and agreement; and adequate time and resources for capacity development and good decision making structures.
In particular, I examine two ways that governments can rebuild relationships with Aboriginal and Torres Strait Islander peoples — by improving agreement - making
processes; and through meaningful and
effective consultation and engagement with Aboriginal and Torres Strait Islander peoples.
Regular opportunities to work together and
consultation practices associated with the consultative stance encourage a collaborative
process essential to
effective consultation.

As a result this strong union will produce
effective and good policy, proper
consultation processes and advocacy across the broad scope of issues central to Aboriginal and Torres Strait Islander wellbeing.
