Emergency Protection Order: An EPO is a way to address the immediate safety
of victims
of family violence.
Domestic violence charges include not only domestic assault charges, but also every degree
of felony assault, misdemeanor assault (gross misdemeanor and simple misdemeanor assault), «terroristic threats,» interference with an
emergency call (interference with a 911 call), criminal sexual conduct, child neglect, child endangerment, child abuse, stalking and harassment crimes, violation
of an
Order for
Protection (OFP), or violation
of a Harassment Restraining
Order (HRO).

The PAFVA enables «family members» to obtain

The report identified several uncertainties that landlords and property managers have about

of clarity about how and when tenants may apply for these types
of orders (at 45).
This post will briefly address the unique circumstances in which the FHRMIRA came to be, and then provide an overview and critique
of several provisions: section 7 (exemption for First Nations wishing to enact their own matrimonial real property (MRP) laws), sections 16 - 19 (
emergency protection orders), section 20 (exclusive possession
orders), and section 26 (leases).
This means that for the rest
of the country, the sections pertaining to
emergency protection orders are essentially useless, as there is no authority empowered to grant them.
As noted above, one
of the motivations behind the PAFVA was to make it easier for victims
of family violence to obtain
emergency protection than the previous system
of common law restraining
orders had allowed for.

order of protection, or
emergency restraining
order, may be issued in
order to offer a victim immediate
protection.
Often applications for
protection need to be made on an urgent basis and we have extensive experience
of obtaining and serving
emergency orders.
Most provinces and territories in Canada now have legislation providing for
emergency protection orders in cases
of family violence.

of care applications which have included an application for an

The Act provides options to a person who has experienced violence in a family situation including the option
of obtaining from a court a restraining
order, a peace bond, an

of an
emergency protection order (EPO)(s 62 (3)-RRB-(c)-RRB-; o the making
of an interim
protection order (IPO)(s 63 (2)-RRB-(b)(iii)-RRB-; and o the making
of an LPO (s 45).
In relation to the making
of an
Emergency Protection Order (EPO) under the Bill, section 62 currently requires information to be supplied separately from the originating application, leaving the process open to the involvement
of non-applicant parties and consequential conflict and litigation.
If Children's Services believes a child is in urgent need
of protection, it can ask the court to make an Emergency Protect
protection, it can ask the court to make an
Emergency ProtectionProtection Order.
A Child Assessment
Order can be applied for in non-
emergency situations where there are suspicions
of harm or lack
of parental co-operation, but not grounds for an
Emergency Protection Order or Care
Order.
The provision
of interim and
emergency protection orders are insufficient to provide adequate
protection.
