EU emission trading reforms, known as backloading, involve withholding 900m
emission allowances from the carbon market to address an oversupply of credits.
Authorizes financial assistance to the states using
emission allowances from the SEED accounts.
Establishes limits on the number of
emission allowances from the strategic reserve account that may be auctioned for 2012 - 2016 and for 2017 and thereafter.
-- For each of calendar years 2012 through 2016, the annual limit on the number of

emission allowances from the offsets reserve to fully account for the tons of carbon dioxide equivalent that are no longer sequestered.
«As a gesture of good faith the EU will «stop the clock» on the implementation of the international aspects of its ETS aviation by deferring the obligation to surrender
emissions allowances from air traffic to and from the EU by one year.

The bill aims to ameliorate these effects by allowing emitting plants to continue for a while by buying permits or
allowances from other producers whose
emissions are below their
allowances — hence «cap and trade.»
The state would raise the $ 30 million
from the New York State Energy Research and Development Authority's (NYSERDA) auctioning of carbon dioxide
emission allowances.
E.U. governments asked companies to provide their own, unverified historical
emissions data, and many inflated their numbers so as to claim more free
allowances from government.

Regular auctions to sell the right to pollute, or
allowances, have netted nearly $ 676 million for the states and
emissions have dropped to roughly 120 million metric tons of CO2 — 34 percent below the cap for 2009, according to a report
from Environment Northeast.
In addition, no international offset credits shall be issued for
emission reductions
from activities with respect to which
emission allowances were allocated under section 781 for distribution under part E.
-- For a covered entity described in section 700 (13)(J), 1
emission allowance for each ton of carbon dioxide equivalent of greenhouse gas that would be emitted
from the combustion of the natural gas, and any other gas meeting the specifications for commingling with natural gas for purposes of delivery, that such entity delivered during the previous calendar year to customers that are not covered entities, assuming no capture and sequestration of that greenhouse gas.
-- Where carbon dioxide (or another greenhouse gas) generated by a covered entity is used as an input in the production of algae - based fuels, the Administrator shall ensure that
emission allowances are required to be held either for the carbon dioxide generated by a covered entity that is used to grow the algae or for the portion of the carbon dioxide emitted
from combustion of the fuel produced
from such algae that is attributable to carbon dioxide generated by a covered entity, but not for both.

However, «study after study predicts that carbon
emissions will keep growing by roughly three percent a year — and at that rate, we'll blow through our 565 - gigaton
allowance in 16 years, around the time today's preschoolers will be graduating
from high school.»
The program reduces the number of available
allowances issued each year to ensure that aggregate
emissions from the covered entities are reduced by 3 % below 2005 levels in 2012, 20 % below 2005 levels in 2020, 42 % below 2005 levels in 2030, and 83 % below 2005 levels in 2050.

Furthermore, companies failing to surrender enough
allowances to match their
emissions will be deducted twice the amount of
allowances from the following year's allocation and are fined CNY 50,000 (USD 7,398).
Second, a reference emergency pathway should not be so vague when it comes to defining overall global
emissions allowances, or indeed in specifying what «substantial deviation
from baseline» in the «non-Annex I» developing world actually means.
Furthermore, companies that fail to surrender enough
allowances to match their
emissions will be deducted twice the amount of
allowances from next year's allocation and are fined one to three times the average market price for every
allowance, with a maximum limit of CNY 150,000 (USD 22,195).
Allowances for aviation and shipping were set aside within the 80 % by 2050 goal in a way that — for example — did not allow for rising
emissions from a third runway at Heathrow.
The New York investments
from the RGGI
allowance auction revenues are expected to only reduce
emissions 89,531 tons at an average investment rate of $ 81.5 million.
States will withhold
allowances from circulation to secure additional
emissions reductions if prices fall below established trigger prices.
The first phase of the EU ETS —
from 2005 to 2007 — drew criticism for not achieving substantial cuts in
emissions, excessive
allowance price volatility and for resulting in windfall profits for some utility firms that received carbon
allowances for free but were able to pass through their full cost to consumers in the form of higher electricity prices.
Participants sourcing
from affected facilities must match this generation with either a) the retirement of eligible
emissions allowances or b) the retirement of «Green - e compliant ERUs,» which were generated as a result of
emissions reductions beyond the
emissions reduction pathway at a covered party.
Taking into account their ability to pass on the increased cost of
emission allowances, full auctioning is the rule
from 2013 onwards for electricity generators.
Plants that exceed their
allowances must either reduce their
emissions, or buy spare
allowances from within the market, with the price determined by how many
allowances are up for sale and how many are needed.
EPA proposes to set aside
from the
emission budget for the first compliance period up to 300 million CO2
allowances for use as matching early action
allowances under the CEIP.
And President Barack Obama has called for a national cap - and - trade system that would set greenhouse - gas
emission limits for many businesses and require those that exceeded them to buy
allowances from others that haven't (see Chu's Wish List: Cap - and - Trade and Cheaper Solar).

Requires the EPA Administrator to promulgate regulations establishing a program to use
emission allowances set aside to reduce GHG
emissions from deforestation in developing countries, with the objectives to: (1) achieve 720 million tons of reductions in 2020 and a cumulative
emission reduction of 6 billion tons by 2025, (2) build institutional capacities in developing nations; and (3) preserve intact, native forests.
Emissions from power plants in New York State are down approximately 45 percent since 2005, and auction proceeds
from sale of the RGGI
allowances have reduced electricity expenditures and created thousands of green energy sector jobs.
In addition, no international offset credits shall be issued for
emission reductions
from activities with respect to which
emission allowances were allocated under section 781 for distribution under part E.
(4) documentation of the amount of energy savings,
emission reductions, renewable energy deployment, and new or retooled manufacturing capacity resulting
from the use of such
allowances or
allowance value; and
«For the purposes of decreasing the likelihood of catastrophic climate change, preserving tropical forests, building capacity to generate offset credits, and facilitating international action on global warming, the Administrator shall set aside the percentage specified in section 781 of the quantity of
emission allowances established under section 721 (a) for each year, to be used to achieve a reduction of greenhouse gas
emissions from deforestation in developing countries in accordance with part E.
-- For a covered entity described in section 700 (13)(F), (G), or (H), 1
emission allowance for each ton of carbon dioxide equivalent of greenhouse gas that such covered entity emitted in the previous calendar year, excluding
emissions resulting
from --
«(2) To be distributed in accordance with section 304 of the Energy Conservation and Production Act, as amended by section 201 of the American Clean Energy and Security Act of 2009, for each vintage year
from 2012 through 2050, 0.5 percent of
emission allowances established for that year under section 721 (a).
-- For a covered entity described in section 700 (13)(A), 1
emission allowance for each ton of carbon dioxide equivalent of greenhouse gas that such covered entity emitted in the previous calendar year, excluding
emissions resulting
from the combustion of --
-- Not later than September 30 of each calendar year
from 2011 through 2028, the Administrator shall, in accordance with this subsection, distribute
emission allowances allocated pursuant to section 782 (a)(2) for the following vintage year.
-- For a covered entity described in section 700 (13)(I), 1
emission allowance for each ton of carbon dioxide equivalent of greenhouse gas that the devices emitted in the previous calendar year, excluding
emissions resulting
from the combustion of --
«(3) to eliminate or reduce distribution of
emission allowances under subpart 1 when such distribution is no longer necessary to prevent carbon leakage
from eligible industrial sectors.
Such programs incentivize «climate action» by reallocating
allowances under a future
emissions budget or cap
from those who don't take early action to those who do.
--(1) The Administrator shall auction pursuant to section 791
emission allowances for the benefit of workers pursuant to part 2 of subtitle B of the American Clean Energy and Security Act of 2009 in the following amounts, and shall deposit into the Climate Change Worker Adjustment Assistance Fund established pursuant to section 793, and report to the Secretary of Labor on, the proceeds
from the sale of these
allowances:
-- Not later than 2 years after the date of enactment of this title, the Administrator, in consultation with the Administrator of USAID and any other appropriate agencies, shall promulgate regulations establishing a program to use
emission allowances set aside for this purpose under section 781 to reduce greenhouse gas
emissions from deforestation in developing countries in accordance with the requirements of this part.
-- Where carbon dioxide (or another greenhouse gas) generated by a covered entity is used as an input in the production of algae - based fuels, the Administrator shall ensure that
emission allowances are required to be held either for the carbon dioxide generated by a covered entity that is used to grow the algae or for the portion of the carbon dioxide emitted
from combustion of the fuel produced
from such algae that is attributable to carbon dioxide generated by a covered entity, but not for both.
Decisions could be taken in Copenhagen to reduce
emissions and raise money
from international aviation and shipping or the auctioning of
allowances.
