months at the time
of her without cause termination, damages reflective
of six
months of reasonable notice.
The trial judge agreed,
awarding the 20 - year
employee, who had received «excellent» performance reviews, damages equating to 20
months» worth
of salary and benefits.

of pay in lieu
of notice in accordance with the clause, the

In Munoz v Sierra Systems Group Inc, 2016 BCCA 140, the B.C. Court
of Appeal recently considered a notice

In its recent decision in Ozorio v. Canadian Hearing Society, the Ontario Superior Court
of Justice
awarded 24
months» notice to a 60 - year - old
employee following her termination.

This tendency is so strong that many people believe that there is a rule
of thumb that
awards a dismissed
employee, as an example, one
month of notice for every year
of service.
Nevertheless, a review
of the caselaw reveals that many decisions do implicitly apply what is sometimes described as a «rule
of thumb» and
award the dismissed
employee with approximately one
month of notice for every year
of service.
That said, short service
employees often are
awarded more than 1
month of notice for ever year
of service.
Short service
employees (i.e. less than 3 years) tend to be
awarded notice periods
of more than 1
month per year
of service.
