from providing drug and alcohol testing services in any capacity to any DOT - regulated
employer for a period of 5 years.
(11) For any service
agent, disclosing an employee's test result information to any party this part or a DOT agency regulation does not authorize, including by obtaining a «blanket» consent
from employees or by creating a data base
from which
employers or
others can retrieve an employee's DOT test results without the specific consent of the employee;
(c) You must not transmit drug test results directly
from the laboratory to the
employer (by electronic or
other means) or to a service
agent who forwards them to the
employer.
(d) Nothing in this subpart precludes a DOT agency or the Inspector General
from taking
other action authorized by its regulations with respect to service
agents or
employers that violate its regulations.
(4) If the
employer objects, the trade union must satisfy the Board that no conflict of interest would result
from the trade union becoming the bargaining
agent or
from including persons
other than guards in the bargaining unit.
