an employment standards inspection blitz targeting organizations that employ unpaid interns.

The burden of proof will shift to employers to demonstrate that any independent contractors they do business with are not in fact employees under the ESA, if, during the course of an
employment standards officer's investigation or
inspection or in any proceeding under the ESA, other than a prosecution, an employer or alleged employer claims that a person is not an employee.
These laws are imposed to protect innocent drivers and include
standards on truck maintenance, driver training, truck
inspections and
employment.
Nothing in this section precludes an
employment standards officer from conducting an investigation or
inspection, and from taking any other enforcement action under the ESA as the officer considers appropriate.
The client will ensure that the records required to be retained are readily available for
inspection as required by an
employment standards officer, even if the agency has arranged for another person to retain them.
