A recent unreported decision (ENRC NV v Zamin Ferrous Limited [2015] JRC 217) has demonstrated the Jersey Royal Court's willingness to make disclosure
orders not only to police post-judgment freezing
orders but also to ensure that judgment creditors have all the information they need to
enforce their judgments
worldwide.
A notable example is Jenington International Inc v. Kanat Assaubayev, a
worldwide freezing injunction for US$ 500 million in the Chancery Division along with permission to
enforce that injunction outside the jurisdiction in accordance with the Dadourian guidelines, Norwich Pharmacal disclosure
orders and search
orders in respect of 3 premises in London.
Using the same provision, Cruz City 1 Mauritius Holdings («Cruz City»)(represented by White & Case) recently obtained an
order requiring the losing parties in an arbitration to disclose their assets
worldwide, to assist Cruz City in
enforcing against these parties arbitral awards of US$ 298 million.
