The Department of
Environmental Conservation violated federal law by allowing manure control plans to be certified by the same private
experts hired by farmers to craft the plans, and by keeping plans confidential from the public, according to a ruling in Albany this week by Acting State Supreme Court
Justice David Weinstein.
He has testified as an
expert witness on the theology, ethics, science, and economics of climate change policy before the U.S. Senate Environment and Public Works Committee and the Energy and Environment Subcommittee of the U.S. House of Representatives Committee on Energy and Commerce; briefed the White House Council on
Environmental Policy; delivered a paper at a conference at the Vatican sponsored by the Pontifical Council for
Justice and Peace; and spoken at the 2008, 2009, and 2010 International Conferences on Climate Change and at colleges, churches, and other venues.
It remains to be seen how this will apply to a broader public consultation on a complex area by an
expert decision - maker, particularly in the context of
environmental decision - making, where the Aarhus Convention and Mr Justice Sullivan's report on environmental justice [Ensuring Access to Environmental Justice in England and Wales; report of the working group on access to environmental justice, May 2008] continue to shape an increasingly rigorous approach to
