However, TC Heartland did not discuss what was meant by the second prong of the venue statute, i.e. when defendants could be considered to have a «regular and
established place of business.»
Because that term had not been applied for some time, courts have variously determined what, exactly, constitutes a «regular and
established place of business.»
One decision, Raytheon Co. v. Cray, Inc., written by Judge Gilstrap (a judge who at one point had ~ 25 % of all patent cases in the entire country before him) appeared to take a broad view of what it meant to have a «regular and
established place of business.»
This statute says that venue in patent cases is proper either (1) where the defendant «resides» or (2) where the defendant has «committed acts of infringement and has a regular and
established place of business.»
In TC Heartland v. Kraft Foods, the court ruled that patent owners can sue corporate defendants only in districts where the defendant is incorporated or has committed acts of infringement and has a regular and
established place of business.
In TC Heartland v. Kraft Foods, the U.S. Supreme Court ruled that patent owners can sue corporate defendants only in districts where the defendant is incorporated or has committed acts of infringement and has a regular and
established place of business.
Your established place of business must meet the following requirements:
You must maintain an «
established place of business» to run a driving school in CA, although you may have classroom space at a separate location.
You have
an established place of business, at least one licensed driving instructor (probably yourself, at first), and a motor vehicle which has been inspected for driver training purposes.
The patent venue statute states that venue is appropriate either: (1) «in the judicial district where the defendant resides,» or (2) «where the defendant has committed acts of infringement and has a regular and
established place of business.»
From here out, defendants can still be sued in a district such as E.D. Tex. if they have a regular and
established place of business in it, but the decision is likely to shrink what I called in my January preview a «jackpot patent litigation sector... that shifts around billions of dollar.»
The literature suggests that, because of fears of jury bias, foreign patent holders are less likely to sue in the United States than are domestic patent holders; when they do, they put forward only their strongest patents.4 While jury bias is a serious problem, it is made worse by venue rules that limit actions to the jurisdiction in which the infringer is either incorporated or «has committed acts of infringement and has a regular and
established place of business.»
After TC Heartland, patent holders will be limited to filing suit: (1) in the state of the alleged infringer's incorporation; or (2) the state where the infringer committed an infringing act and has a regular,
established place of business.
This ruling will limit venue to districts where the defendant is incorporated or has a regular and
established place of business and also infringes.
ZTE argued that its contract with a call center in Plano, Texas was insufficient to establish that it had «a regular and
established place of business» in that district and that the district court erred in placing the burden of the proof on it to show that venue was improper.
The U.S. Supreme Court has rejected the prevailing interpretation of the patent venue statute, 28 U.S.C. § 1400 (b), and held in an 8 - 0 decision that a domestic corporation defendant may be sued for patent infringement only in its state of incorporation or in a district where it allegedly «committed acts of infringement and has a regular and
established place of business.»
Second, the appeals court ruled that there «must be a regular and
established place of business,» which requires a business that is «steady,» «uniform,» «orderly,» and «methodical» in manner.
As a result, a patent owner has two venue options for defendants that are domestic corporations: It may file the infringement action in the defendant's state of incorporation, or in a judicial district where the defendant allegedly has committed acts of infringement and has a regular and
established place of business.
The statute provides that suits for patent infringement may be brought only «in the judicial district where the defendant resides, or where the defendant has committed acts of infringement and has a regular and
established place of business.»
This meant most patent cases had to be filed in the defendant's home state or where they had a regular and
established place of business.
In particular, this newly - issued decision held that a «regular and
established place of business» under 28 USC 1400 (b) for patent cases must include these three components:
US corporations will likely seek to transfer existing patent cases out of districts where they lack incorporation or a regular and
established place of business.
[1] The Supreme Court's decision will likely lead to litigation that more clearly defines the scope of what exactly constitutes a «regular and
established place of business,» since patentees wanting to sue in a district other than an alleged infringer's state of incorporation will now be required to rely on this relatively untested venue analysis.

On May 22, the justices unanimously ruled that patent owners can only bring patent infringement lawsuits in districts where the defendant is incorporated or has a regular and
established place of business.
