Comment: Several commenters suggested that we add a provision in the final rule to provide minors and parents with concurrent
rights under certain
circumstances, particularly when the minor reaches 16 years of age or when a parent authorizes his or her minor child to

Under the general rule, in most
circumstances the minor would not have the capacity to act as the individual, and the parent would be able to
