Many states have begun enacting «
failure to protect» laws, whereby a parent who knows another parent (or sibling / domestic partner - anyone who
lives in the home) is abusing their child has an affirmative duty to protect the abuse from occurring, and
failure to do so often carries the same penalties as the actual abuser
faces.
If the government were to use the criminal law as a means of enforcing its public health agenda, we could potentially
face the prosecution of parents for all manner of actual or perceived
failures in respect of their children's health, including those who refuse or fail to vaccinate their children, because that exposes them to potentially
life - threatening diseases and threatens the health of others by diminishing the «herd immunity»
