Family legal aid cuts are having a major impact while falling crime has made further budget cuts unnecessary, according to the Bar Council

family legal aid cuts on victims of domestic abuse.
Our experience is, in short, that the continuing severity of
the family legal aid cuts has nullified any positive impact of the latest changes to the system.
The result, due to be implemented on 14 October, would have seen the number of firms contracted to supply
family legal aid cut from 2,400 to 1,300.

The reforms would also create financial savings, notably a
cut in the costs of
Legal Aid to those contesting cases in the
family courts.
The new

In February 2014 we reported that

Nearly one quarter of the 85 leading
family lawyers taking part in the survey said their most pressing issue was litigants in person, which are increasingly common due to
cuts in
legal aid and public funding for advice centres.
Earlier this year the Judicial Executive Board launched a stinging attack on the
cuts to civil
legal aid in relation to the
family courts.
With
cuts to
family legal aid due in 2013, and government plans to charge for child support assessments on the horizon, there is some irony in the obligation imposed by Art 15 for the provision of free
legal advice (subject to a merits test) in 2007 Convention cases.
On the
legal aid cuts it comments: «A consequence (unintended perhaps, but in fact entirely foreseeable) which threatens swiftly to engulf and maybe even overwhelm the judicial system is that
family courts at all levels will become thronged with a tsunami of LIPs... The quality of justice will be strained, its administration delayed, its delivery potentially denied.»
The financial woes of
legal aid firms have been well documented in NLJ: criminal defence firms haven't had an increase in fees for 20 years and in 2014 had to endure an 8.75 %
cut; and most social welfare law and publicly - funded
family legal work was wiped out by the 2013 LASPO
cuts.
While all residents of British Columbia have been impacted by significant
cuts to
legal aid starting in 2002, the services that were (and continue to be) disproportionately accessed by women —
family law and poverty law — sustained the deepest
cuts.
More than a decade ago,
legal aid in BC was drastically
cut by 40 % overall and by 60 % for
family law, so that today 3 out of every 5 applications for
family law
legal aid representation are denied.
As expected,
legal aid in
family court cases will be significantly
cut.
The amount of
legal aid available for
family law matters in BC has been drastically
cut since 2002.
With the
cuts to
legal aid for
family related matters this is more prevalent now then it has ever been.
She pointed out that the
cuts to
legal aid were supposed to preserve access for the most vulnerable in society; however this has not been the case and the
cuts that have been made were short sighted and didn't take into account the longer term impact on society and
family relationships.
The reforms and

legal aid are huge concerns facing all
family lawyers and it is therefore so important that we continue to use our collective voices to ensure that
families and in particular children all have access to
legal representation if and when needed».
Cuts to
legal aid provision have led to an increasing number of people appearing as litigants in person, especially in the
family courts and most particularly in divorce cases.

The proposed
cuts are outlined in a newly published Ministry of Justice consultation paper — Reforming the
Legal Aid Family Barrister Fee Scheme.
Last month, the Ministry of Justice restricted

family law, the paper notes that the Cooperative, an ABS with a social mission, has not been able to halt the massive increase in unrepresented litigants arising from the
legal aid cuts of 2013 despite being one of the largest providers of
family law services.
The paper examines two aspects of the English experience namely the effect of ABS on the personal injury and the insurance industry and the relatively limited impact of ABS on
family law as opposed to the significant impact of
cuts in
legal aid.
Yet, massive
cuts to
legal aid for
family law in B.C. have had a dramatic, negative and disproportionate effect on women's ability to access justice.
And, while our services can't fully address the crisis in the provision of
family law
legal help triggered by
legal aid cuts, they provide an excellent first step by enhancing access to and visibility of the
legal options that are available in an efficient, non-intimidating and transparent way.
