Daiichi Sankyo CFO Manabu Sakai told reporters and analysts on a conference call, «We need to grasp how something like this could occur, how extensive the transgressions were and whether they were
the fault of a particular person.»
This is typically not easy to do, in
particular for specialized professional, and it requires a showing
of (i)
fault on the part
of the buyer or a third
person, (ii) force majeure, (iii) development risks, or that (iv) the professional seller's selection
of goods was reasonable and well informed and there was no way for it to verify the existence
of such latent defect.
