First, there is the increased demand for Alternative
Fee Arrangements (AFAs): clients don't
like billable hours because they prefer to know in advance how much something will cost.
Information about
fees, for example, would seem to be most useful in respect of the provision of certain discrete legal goods (
like, for example, wills) or in respect of standardized
fee arrangements (
like, for example, contingency
fees).
[/ strong] We have a mixed bag of alternative
fee arrangements, from caps to volume discounts, and a combination of
arrangements like that.
It's a natural reaction for lawyers and law firms to resist it because they would
like to retain the hourly billing at a non-budgeted amount, but there are lawyers and firms that actually come to the table and offer the alternative
fee arrangement — it could be a cap on certain things, or a volume discount.
