But it would provide a legal safety net
for those cohabitants who currently — wrongly — believe they have legal rights.

cohabitants, or opt out, ie it should apply to all eligible
cohabitants unless they specifically agree otherwise.
People wouldn't do it
for many of the same reasons that they don't marry and it would do nothing to protect vulnerable
cohabitants from unscrupulous partners who deliberately choose not to opt in precisely because they don't want to take on responsibility
for their partner and children.
The law already gives limited protection to
cohabitants with children in that they can apply
for orders under the Children Act 1989, Sch 1 on behalf of their children — albeit that such provision lasts only while the children are dependent.
It also asks
for views about whether other
cohabitants should be eligible to apply, perhaps after a minimum period.
The law has been letting down
cohabitants for much too long.
The likelihood is that the commission will say that its scheme should apply also to
cohabitants without children after they have lived together
for two years.
Let us hope that legislation is enacted before long so that
cohabitants can finally get the justice they have waited so long
for.
Cohabitants are already able to make application under Inheritance (Provision
for Family and Dependants) Act 1975 (I (PFD) A 1975) upon death of the former
cohabitant provided that they can show they have cohabited
for at least two years.
They did not remarry but resumed living together and Ms Chekov brought a claim
for reasonable financial provision as Mr Fryer's

Whatever the arguments
for and against, no positive action has arisen in connection with the Law Commission's report and
cohabitants are in no better position than they were since it was commissioned.
Where a property is in the sole name of one
cohabitant, in the absence of any express declaration, the doctrine of constructive trusts will need to be carefully considered when trying to establish a benefi cial interest
for a non-owner.
But, without the power to vary any interest, the Act does little to ensure that
cohabitants are adequately and fairly provided
for upon the breakdown of a relationship.
A former
cohabitant was entitled to a half share of the home he lived in with his girlfriend despite the fact he had neither paid
for nor lived in it since 1993.

While the aim of providing genuine fairness
