for waiver renewal — and many of them are struggling to meet the promises they made in order to be allowed to ignore federal law.

New NCLB
waiver renewal guidance will allow the majority of states to renew their
waivers for another three years — through the 2017 — 18 school year.
Automatic closure laws «identify a threshold of minimally - acceptable performance»
for charter schools; schools falling below this threshold at the time of
renewal, or that remain below this threshold
for a set amount of time, are automatically closed.29 The National Association
for Charter School Authorizers (NACSA) recommends that at a minimum closure laws define: 1) the number of years of poor performance that prompts school closures; 2) the level of performance that triggers closure; 3) what entity has discretion to make exceptions and the structure of any
waiver process; and 4) if applicable, what types of schools can be exempt from closure policies or apply
for waivers.

renewal of NCLB — the current version of the Elementary and Secondary Education Act — remains stalled in Congress, so

waivers are the law of the land: Forty - one states, Washington, D.C. and eight districts in California all have NCLB
waivers.

for using federal Title II funds
