I am home from the terrific Miami FSG conference (kudos to everyone involved), and on the way I was thinking
about Judge Rakoff's decision this past week to give an enormous variance — the largest I have seen — to a corporate president who apparently faced a life sentence under the
guidelines after a fraud conviction that resulted in $ 260 million in losses (basics here).
In felony cases, the Federal or Minnesota Sentencing
Guidelines will provide guidance to the
Judge about the sentence.
In his response Young also recommends that the extent to which
judges depart from the
guidelines should be monitored, and says that access to reliable data is essential to permit forecasting
about the likely effect of sentencing
guidelines on the prison population.
The Court properly and succinctly recognized that unless sentencing
judges are allowed to define their alternative scorings categorically and honestly, there are only two possible outcomes: Either the
guidelines are essentially mandatory, or

about their reasoning, which is «institutional subterfuge.»

Judge Richard Kopf (Neb):» [J] udges obviously know more
about the individuals we sentence than many other people [but] the significance of this truism to the statutory goals of sentencing is often zilch... [T] he importance of «knowing the person» is overstated by those who want excuses to do something different than what the
Guidelines dictate....
(ii) The matters to be dealt with are: - the aggravating and mitigating factors of the offence (not personal mitigation); - any statutory provisions relevant to the offender and the offence under consideration so that the
judge is made aware of any statutory limitations on sentencing; - any relevant sentencing
guidelines and
guideline cases; - identifying any victim personal statement or other information available to the prosecution advocate
about the impact of the offence on the victim; - where appropriate, any evidence of the impact of the offending on a community; - an indication, where applicable, of an intention to apply for any ancillary orders, such as anti-social behaviour orders and confiscation orders, and so far as possible, indicating the nature of the order to be sought.
