The information published on a court web site may come from a variety of authors: judges, court staff (e.g. employees of courts administration), the justice department / ministry, public servants, lawyers (e.g.
if factums are available on the court web site), etc..

In substance, I don't see any difference between preparing a pleading (including a
factum) filed in court that some layer then copies, or writing an article for a legal journal that tells some lawyer exactly how his or her argument should be made, even
if it doesn't contain the exact words.
If you are not represented by a lawyer, you do not have to file a formal
factum.
At the same time as the appellant serves you with the appeal book, he or she will serve you with a
factum (
if he or she is represented by a lawyer) or a written argument.

factum (the lawyer who really wanted to be a writer) that a lawyer at another firm has filed in a court proceeding?
I don't know who
if anyone is betatesting this in Canada, but it would be a good idea for Canadian researchers to check the US Westlaw version to see
if all the panoply of documents available in the US is relevant or necessary in Canada, outside of the
factums that is.
It should be easier and cheaper to provide public access to the
factums — the court could require them to be filed in soft as well as hard copy,
if it does not do so already.
And
