Generally, exclusion of refugees is grounded in the hyped fears of employers and service providers that the Immigration Act of 2002 could
impose penalties on them if they do not comply with its rules.15 This misconception is further reinforced by
political statements, which hold that the majority of refugees are bogus or economic migrants who are in South Africa in a search of a better life.16 There is apparently an inability to distinguish between applicability of the immigration regime and refugee regime.17 However, it is true that the Refugees Act of 1998 strictly exempts refugees and
asylum - seekers from the immigration restrictive measures
imposed on non-citizens in certain circumstances.
