A family court could find that you are separated even if you and your spouse are continuing to live under the same roof and even if the Canada Revenue Agency has the view that you are still
cohabiting together
in a married or common - law
relationship.

in May 2006 and the conclusions and final report are expected later this summer, it will not contain a draft Bill and — due to the apparent lack of funding on this issue — it is highly unlikely that there will be any changes
in the law relating to
cohabiting couples
in the foreseeable future.
Stack v Dowden: a distinction The House of Lords
in Stack v Dowden [2007] All ER (D) 208 (Apr) did make a distinction between the
relationship of a
cohabiting couple and that which is purely commercial.
