of an estimated 40 %
of domestic violence, and outnumbering women in rape statistics if prison rapes are
included.

include showing a film (Racing Extinction or Cowspiracy: The Sustainability Secret) and hosting a speaker from Harbor House, a shelter for
victims of domestic violence and their companion animals, to speak about the link between
domestic violence and animal
abuse.

With respect to comments regarding the lack
of procedural safeguards for individuals,
including those who are
victims of domestic violence and
abuse, we note that the rule does not provide new authority for covered entities providing health care to individuals who are Armed Forces personnel to use and disclose protected health information.
In addition, as discussed above, the final rule
includes a new § 164.512 (c), which establishes conditions for disclosure
of protected health information about
victims of abuse, neglect or
domestic violence.
Comment: Many commenters,
including consumer and provider groups, expressed concern that allowing covered entities to disclose protected health information without authorization to law enforcement regarding
victims of crime,
abuse, and other harm could endanger
victims, particularly
victims of domestic violence, who could suffer further
abuse if their abuser learned that the information had been reported.
We also
include a new § 164.512 (c) which recognizes the unique circumstances surrounding disclosure
of protected health information about
victims of abuse, neglect, and
domestic violence.
The new § 164.512
includes paragraphs on: Uses and disclosures required by law; uses and disclosures for public health activities; disclosures about
victims of abuse, neglect, or
domestic violence; uses and disclosures for health oversight activities; disclosures for judicial and administrative proceedings; disclosures for law enforcement purposes; uses and disclosures about decedents; uses and disclosures for cadaveric donation
of organs, eyes, or tissues; uses and disclosures for research purposes; uses and disclosures to avert a serious threat to health or safety (which we had called «emergency circumstances» in the NPRM); uses and disclosures for specialized government functions (referred to as «specialized classes» in the NPRM); and disclosures to comply with workers» compensation laws.
As discussed above, the final rule
includes a new section (§ 164.512 (c)-RRB- establishing strict conditions for disclosure
of protected health information about
victims of abuse, neglect, and
domestic violence.

victim / witness to community violence, school violence, natural or manmade disasters, forced displacement, war / terrorism,
victim / witness to extreme personal / interpersonal violence, traumatic grief / separation, and system - induced trauma.
(e) Either party has had a history
of domestic violence as either a
victim or perpetrator, child
abuse or child neglect evidenced by criminal history,
including but not limited to, arrest, an injunction for protection against
domestic violence issued after notice and hearing under s. 741.30, medical records, affidavits, or any other relevant information;

In Virginia, for example, if there is proven history
of domestic or child
abuse, or if there are high - risk factors involved like prior use
of weapons, physical violence
including sexual attack or attempt to strangulate, or the infliction serious physical injuries on the
victim, then mediation is not mandatory.
