One particularly tragic case took place recently and
involved litigants in person in private law children proceedings, who historically would have had the benefit of legally aided representation.
In another FOI request, the TUC asked for information about the number of domestic violence cases that
involved litigants in person during the periods 1 January to 31 December 2011, and 1 January to December 2015.
One can understand the frustration of judges when bundles are badly prepared / late / missing, but save in the most affluent of cases the preparation of bundles will often be onerous and time - consuming particularly in cases
involving litigants in person (where the respondent, if legally represented, now has to prepare the bundle if the applicant is unrepresented).

While shedding further light on an aspect of the law seldom visited, highlighting the risks
involved in filing documents
in a manner which can not be tracked / traced and illustrating the types of complication with which the courts will increasingly have to deal with ever more
litigants in person, the case is perhaps most striking for what it highlights about the current fault - based divorce system.
If more and more
people are
in the courts, cases will have to become more efficient, which could
involve creating even more free resources for pro se
litigants, and making it easier for individuals to represent themselves.
This is probably helpful for
people involved in a court proceeding, as the bubble of
litigants noted by the Macfarlane and Malcolmson and Reid reports falls right
in the midst of this age group.
The courts simply can not cope with the extra work
involved where the
litigants are
in person.
Speaking at the 20th Annual Bond Solon Expert Witness Conference, Tim Dutton QC said it would be «difficult» to set up a separate regulatory entity for experts, and problems would arise particularly where
litigants -
in -
person are
involved.
What we need is foresight and backbone by government so that it can reduce what it wastes on funding unneeded law and paralegal students, what it wastes on clogged courts hearing unprepared
people squabbling over their kids, what it wastes on judges and staff
involved in trials that could have been avoided, what it wastes on health care for stressed out
litigants, what it loses
in harmed productivity
in the workplace by stressed out
litigants, and so on.

This will often
involve lengthy discussions with
litigants in person.
We have recently become
involved to a degree with the excellent work carried out by Brad Meyer and the Help4Lips (Help for
litigants in person) charity and project.
I understand from Justice Stanley Sherr, a brilliant jurist and one of the
people most responsible for creating and promoting this process, that these trials are popular among the bar, as they are
involved in designing the hearing and it gives their clients greater certainty as to cost and date of resolution, and among
litigants, as their cases are heard much more quickly at far less cost.
