It is not to incur substantial and
irrecoverable costs on a long shot bet.
In Ward LJ's view, the trial judge was correct in taking into account the «
irrecoverable cost incurred by the claimant in continuing to contest the case».

After the event insurance premiums will be
irrecoverable from the paying party under the new regime by dint of s 58C of the Courts and Legal Services Act 1990 when it is brought into force on 1 April 2013 — except in clinical negligence cases and even then recoverability will be limited to the extent that the premium relates to the
