[154] It is now submitted on behalf of the defendant in this civil action that the issue of liability has been decided in his favour by the previous criminal proceedings.

If the matter is one essentially based on an existing civil action, but has a human rights component, then a court could assume jurisdiction to decide all issues in a single proceeding.
