With almost twenty years
of experience handling civil cases
of all
kinds, and having represented hundreds
of clients before trial courts and courts
of appeal in both Florida and Montana, I know just how crucial
legal research and writing truly are.
Next week I will have the opportunity to join with a number
of colleagues on a panel to discuss with law school students the importance
of legal research and writing, largely in anticipation
of them becoming lawyers on graduation and needing to have certain skills in order to excel in their profession (and I think it is great that this law school is making this
kind of session available to students).
Doing
legal research is
kind of clunky, when you think about it.
I think there's always going to be room for them maybe in the secondary market or in workflow or things like that, but I do think that there is that — in the same way that Starbucks made coffee a lot more accessible to people and created a lot more coffee drinkers and made the experience more enjoyable and really
kind of raised the floor for coffee in America, I think there's room for a company like Fastcase to raise the floor for everybody to make
legal research something that isn't intimidating, that partners can do and young associates can do and law students can do in a compelling, powerful way and without being afraid.
So it shouldn't be like a
kind of barebones thing, through your Bar Association or through your mobile app or through your iPad, you can get very good
legal research everywhere.
If you think about, when we started Fastcase in 1999,
legal publishing and
legal research were in
kind of an AOL world, where you paid for access.

kind of all look the same, but they are not the same.

legal advice, but they do help with basic

Such support services can be created for every
kind of work or service that law firms find difficult to make earn a profit, e.g.,
legal research and electronic discovery.
That being said, the conflict itself fuels a demand for the
kind of research and development that
legal hackers want.
My point was that a lot
of legal work is routine — an occupational hazard for some lawyers is simply boredom, doing the same things over and over again — and it would be irresponsible for a lawyer to do, let alone require the client to pay for,
legal research in those
kinds of matters.
