Redcar & Cleveland Borough Council v Bainbridge; Surtees v Middlesbrough Borough Council concerned «pay protection» measures adopted by local authorities to provide employees, whose pay was to be reduced under a new job evaluation scheme, with a soft landing where the decrease in pay would be brought in gradually.

[1] The issue in this case is whether the British Columbia Minister of Forests, Lands and Natural Resource Operations («Minister») erred in approving a ski resort development, despite claims by the Ktunaxa that the development would breach their constitutional right to freedom of religion and to protection of Aboriginal interests under s. 35 of the Constitution Act, 1982.

despite the reforms to the native title system, the high cost, complexity and strict rules of evidence applying to claims under the Native Title Act, have a negative impact on the recognition and protection of the right of indigenous peoples to their ancestral lands.

Under the Canadian Constitution Act 1982, land claim agreements and treaty rights have legislative protections without any derogation of these rights in preference to other agreements or rights.

There are two Commonwealth National Parks in the Northern Territory - Kakadu National Park and Uluru - Kata Tjuta National Park in which freehold title is held by Traditional Owners under the Aboriginal Land Rights (Northern Territory) Act 1976 (Cth) which are then leased back and jointly managed in accordance with the Environmental Protection and Biodiversity Conservation Act 1999 (Cth).

Under these easements, land owners voluntarily give an environmental organization or government entity a nonpossessive interest in property for conservation purposes such as the protection of a natural habitat or preservation of a forest or farmland.
