later than 90 days after the end
of each calendar year, the
Administrator shall establish and distribute to the entity taking the actions described in subparagraph (A), (B), or (C)
of paragraph (1) a quantity
of compensatory allowances equivalent to the
number of tons
of carbon dioxide equivalent
of avoided emissions achieved through such actions.
A covered entity's allowable emissions level for each calendar year is the
number of emission allowances (or offset credits or other allowances as provided in subsection (d)-RRB- it holds as
of 12:01 a.m. on April 1 (or a
later date established by the
Administrator under subsection (j)-RRB-
of the following calendar year.
Administrator Jackson approved the California waiver in
late June 2009.24 Johnson's decision denying the waiver sets out a
number of persuasive reasons why she should not have done so.
