The Government's intended
approach in the no - longer - Great Repeal Bill is confirmed in the Queen's Speech — providing for
continuity based on existing EU
law by default as far as possible, and likely doing so en bloc rather than item by item.
Under this
approach a state may enter into negotiations with the traditional owner group either through the mediation process offered under the NTA or by means of their own processes without waiting for the collection of evidence by the claimant group in relation to the
continuity of their connection, the
continuity of their observance of traditional
laws and customs and the compilation of a tenure history by the state.
