Child Left Behind Act and presentation of the Forum
on Educational Accountability (FEA) recommendations to shift the focus of the federal
law from penalties and compliance to a more meaningful framework for
supporting improved learning and stronger school and district performance.
The No
Child Left Behind Act of 2001 (NCLB) is the most recent iteration of the Elementary and Secondary Education Act of 1965 (ESEA), the major federal
law authorizing federal spending
on programs to
support K - 12 schooling.
According to the State of the States in Gifted Education, a biennial analysis of state
laws and policies to
support high - ability and high - potential students conducted by the National Association for Gifted
Children and the Council of State Directors of Programs for the Gifted, 28 states lack even a single gifted education performance indicator
on their annual report cards or other accountability measure.
The Every Student Succeeds Act (ESSA), a major rewrite of the much - maligned No
Child Left Behind Act (NCLB), is the first federal education
law to define the term «evidence - based» and to distinguish between activities with «strong,» «moderate,» and «promising»
support based
on the strength of existing research.
So today I am calling
on all of you to join with us to build a transformative education
law that offers every
child the education they want and need — a
law that recognizes and reinforces the proper role of the federal government to
support and drive reform at the state and local level.
As used in this paragraph, a «Covered Borrower» means any person who, at the time such person becomes obligated
on a loan transaction or establishes an account for consumer credit, satisfies the requirements under any one or more of the following classifications, or is otherwise under applicable
laws deemed to be a «Covered Borrower» under the Military Lending Act, 10 U.S. Code Section 987: (a) An active duty member of the Army, Navy, Marine Corps, Air Force or Coast Guard, or a person serving
on active Guard and Reserve duty (a person described in this clause (a) of the definition of «Covered Borrower» is hereinafter referred to as a «Service Member»); or (b) Any of the following persons, relative to a Service Member: (1) The spouse; (2) A
child under the age of 21; or (3) If dependent

on the Service Member; (iii) Any unmarried person placed in legal custody of the Service Member who resides with such Service Member unless separated by military service or to receive institutional care or under other circumstances covered by Regulation; or (iv) A parent or parent - in -
law residing in the Service Member's household.

law typically restricts garnishing orders to a maximum of 30 % of wages (though
child or spousal
support claims can attach up to 50 % depending
on the debtor's income and the number of dependents).
