In my work with the Canadian Bar Association's Access to Justice Committee and the Association for Canadian Clinical
Legal Education, I have observed three major research opportunities for law faculties that are not being given the attention I feel they
demand.
Delivering access to justice
demands change and action on a very broad range of initiatives — pro bono work by the private bar, fair and adequate funding of
legal aid, collaboration among all system participants (clients, lawyers, courts, agencies, NGO's),
legal education (and its financing), e-filing and case data standards, court forms, court interfaces to self - represented litigants, unbundled
legal services, virtual law practice, multistate practice, law practice ownership and investment, limited practice licenses, unauthorized practice of law rules, lawyer advertising rules, and lawyer discipline.
Moreover, responding to public
demand for improved access to justice and to
legal information requires that CanLII direct greater energy and resources to generating public awareness of its service and to the
education of users.
Choosing this approach would amount to at least a tacit admission that
legal education does not define practice, it simply responds to the
demands of market forces.
This shows us that an
education in technology, quantitative methods, e-discovery, and the current
legal services market is in
demand by bright
legal students.
The Council is under intense pressure to
demand that all law schools adhere to metrics measuring quality
legal education.
Having briefly highlighted the recognition of an unmet
demand for
legal services in Canada, I contend that an expansion of clinical
legal education in the country could present one partial solution to this issue.
As organizations such as the Law Society of BC explore ways that properly supervised law students and paralegals can be utilized to address this issue, I strongly encourage those involved with Law Schools across the country to expand their clinical programs to both provide a well rounded
education to students and to work to fill the existing unmet
demand for
legal services.
The
Legal Education and Admissions Section is being asked to think about law school, at least in part, in terms of producing lawyers with knowledge, skills and values geared towards the practical
demands of a professional life of client service.
As tuition revenue decreases due to slackened
demand for
legal education, we will see how these same decision makers re-allocate scarce resources among competing wants and needs.
