On appeal the respondent argued that in order for an employer to be
liable under the regulations it had to be established that he knew of the use of the piece of equipment.

under this
Regulation in respect of an insured person shall be paid by the insurer that is
liable to pay
under subsection 268 (2) of the Act.

Regulations 1992, and / or (ii) by reason of breaches of the said contracts of various dates for the provision of holidays, made in writing, and within the jurisdiction of this Court, and / or (iii) by reason of the Defendant's negligence during the said period, and / or (iv) by reason of the Defendant's misrepresentations made on various dates and inducung the Claimants to enter the said contracts for the provision of holidays.
Under the
regulations, the defendant remained
liable for the proper performance of the contact.
