The 2010 passage of the «puppy mill bill» placed the commercial pet
breeder regulations
under title 59 of the Oklahoma State Code in a section called Professions and Occupations, and the
licensing compels
breeders to collect and remit sales taxes to the state in a manner consistent with other retail businesses.
In Oklahoma, more than 260 facilities and individuals have
licenses or registrations
under the Animal Welfare Act including dog and cat
breeders, zoos, exotic animal parks, and research institutions.
Breeders that sell puppies to a broker to be resold in pet stores must obtain a dog dealers
license under the USDA.

under $ 500 per year and if they own no more than three breeding female dogs or cats and sell the offspring, into the pet channels.

licensed breeders are exempt
under laws enacted by HSUS?
If a
breeder sold wholesale (i.e., to pet stores), he / she was required to be
licensed under the Animal Welfare Act (AWA).
Under the outdated regulations, this change in selling practices meant that many commercial
breeders no longer were required to be
licensed by USDA as pet dealers, even if they were large scale pet
breeders selling their puppies to consumers through remote methods.
The law does not extend to
licensed breeders who give their animals proper care, but it does also ban the sale of animals
under eight weeks old.
Under current Iowa law, though
licensed, they are exempt from the inspections and other requirements that apply to non-USDA
licensed commercial kennels,

NEW YORK — The ASPCA ® (The American Society for the Prevention of Cruelty to Animals ®) is urging the U.S. Department of Agriculture to reverse its decision to remove public documents from its website related to the inspection of facilities
licensed under the federal Animal Welfare Act (AWA), including zoos, commercial dog
breeders and research labs.
Under the new law, individuals can still buy animals from
licensed breeders, but retails shops can not sell them — they are only permitted to adopt out animals that come from shelters, Humane Societies and registered rescue groups.
Under the Animal Welfare Act (AWA), wholesale animal
breeders — those who sell to pet stores, for instance — are regulated,
licensed and subject to inspections by the Animal and Plant Health Inspection Service at USDA.
The Complaint seeks an Order compelling the Board to annul the commercial
breeder license of this dog
breeder, Deborah Rowell of Cass County, and to prevent the Board from issuing a
license in the future to any
breeder convicted of cruelty to animals
under Minnesota law.
The audit further detailed problems with commercial
breeders who were
licensed under AWA or should have been
licensed under AWA.

licenses to high volume
