Here's the thing about snap
judgments: They seem unfair, but we all
make them.
When they appear is partially a matter of
judgment — will they
make a big impact
here, or should I keep them up my sleeve?
The way we think about it is that a lot of it has to do with a combination of depth - of - knowledge plus depth - of -
judgment, so it's, «What decisions are you entrusted to
make here?»
Here is where things get a bit murky and one must ultimately
make a
judgment call.
There is no intrinsic conflict
here between the two objectives (although actual policy
making still requires some fine

Acting on a motion for summary
judgment filed by Hueston Hennigan, U.S. District Court Judge William H. Orrick held that although courts «sparingly grant summary
