This appeal requires us to decide whether
a medical access regime that only permits access to dried marihuana unjustifiably violates the guarantee of life, liberty and security of the person contrary to s. 7 of the Charter.
It should be noted that people with a mental illness or physical disability would not be excluded from the
regime, but would only be able to
access medical assistance in dying if they met all of the eligibility criteria.
