Research brings this: Seems the clause can be used by
the mere listings people and or by solicitors, just not by registrants, according to an expert on the topic, for reasons noted, not because the clause is illegal.

person can go into a Consumer's home and take a «
mere listing» which is a
listing nonetheless, and must comply with Board Rules and Regulations and RECO,.....
, to «
mere posting» type
listings: «Discrimination The REALTOR ® shall not deny professional services to or be a party to any plan to discriminate against any
Person for reasons of race, national or ethnic origin, religion, colour, sex, family status, age, or sexual orientation, marital status or disability.»
Anyone who believes that all
people taking «
mere listings» are following either the Toronto Board Rules or the Real Estate and Business Brokers Act of Ontario should resign now before they get very disappointed.

Secondly, anyone wishing to see a copy of a recent «
mere listing» (not mine) posted on the Toronto Real Estate Board, where the client had never met a Real Estate representative, (the
