While every litigator learns how to conduct
legal research in law school,
performs legal research on the job (or reviews
research conducted by associates or staff), and applies the fruits of
legal research to the facts of their cases, many may
not yet have encountered
legal analytics.
In earlier posts I've argued that lawyers are
not yet adopting (in material percentages at least) the AI - based tools that can supplement attorneys» traditional, people - intensive — «manual» — ways of reviewing documents for litigation discovery, automating aspects of due diligence in deals,
performing contract management of thousands of a company's agreements, or conducting
legal research (see here and here).
While they are
not able to give
legal advice or
perform the duties of a lawyer, they can conduct
legal research, review and organize client files, help with closings at trials, prepare documents, and so many other important practices that reduce operational costs.
First, I don't think that there's an objective way to measure effective
legal research skills because the amount of
research that lawyers
perform, and the way in which they do so will depend upon the availability of resources.
While advertising and marketing your law practice in search engines will
not make it rain overnight, if you commit to thinking about how your potential clients might use search to consume
legal information, get answers, and
perform research, you might surprise yourself as to how successfully you can increase your firm's profile online.
The ABA Model Rules make it clear that even when you engage non-lawyers to
perform functions in your practice (be it trust accounting, money management,
legal research, or administrative functions), they can
not commit acts you are
not permitted to commit.
It has been said that lawyers do
not necessarily know the law better than other people; rather they only know where to find it.10 A lawyer who does
not know how to
perform legal research is lacking a defining characteristic of the profession.
Second, the Model Rule doesn't mention core competencies, like knowing how to
perform legal research or how to interpret the Rules of Civil Procedure.
The product is intended to be used
not only by associates, but by anyone within a firm or organization who is most intensively involved in
performing legal research.
It does
not entail the
legal and financial
research performed by an appraiser.

legal requirements • Manage real estate disputes including litigation • Providing training to the company on
legal topics •
Performing other duties as required or assigned
