As you noted above with publishers, negotiability is going to depend on how badly the parties want the
deal (i.e. if an agent or publisher really wants the work and the author has options, then the agent or publisher is likely to be willing to
negotiate the

These days this is a personal decision each author has to make, but if publishers would
negotiate on
terms, a marginal advance
deal might work if the number of years for digital rights can be limited before they would automatically revert back to the author (ie 2 - 3 yrs only) or if UK rights were granted but digital rights in the US are retained.
