school years, and has not otherwise demonstrated satisfactory performance on other student achievement indicators determined by the commissioner in consultation with the appropriate
nonpublic school officials.
If, after a further time period established by the commissioner in consultation with appropriate
nonpublic school officials, the
school under department review has not demonstrated progress as determined by the commissioner, the commissioner shall determine that the
school is an unsound educational environment.

under this section may be denied instruction and service... because of attending a
nonpublic school.»
