Although the First
Amendment analysis could resolve the overarching
constitutional question under s. 2 (
b)
of the Charter that protects freedom
of expression and media communication, specific provisions
of wiretap law, governed in Canada by Part VI
of the Criminal Code, would also have to be considered.
