A legal presumption
of equal parenting time effectively converts the current focus on the child's welfare to a best - interests - of - the - parents standard.
Should these cases then have a presumption
of equal parenting time when that is not the reality?
In our survey, the respondents reported that an average of 46 % of their cases involve some form
of equal parenting time («joint physical custody,» «shared custody,» or «shared residence,» in which the children spend at least 40 % of their time with each parent).

of equal parenting time makes sense.
