In some states, an
award of joint physical custody is possible when a child will be staying with both the mother and the father for significant periods of time.
I am in
favor of joint physical custody arrangements, but only when both parents are able to work together and have their children's best interest at heart.
When both parents have provided regular care to the child, judges are encouraged to grant some
form of joint physical custody that works with the child's and parents» needs and schedules.
This is simply due to the fact that the vast majority of divorce cases result in the former occupants of the the marital domicile physically separating, a condition that would preclude the
awarding of joint physical custody.
Because Georgia's Code contains no language that specifically refers to the concept
of joint physical custody, the primary custodial parent would technically have sole physical custody.
