Gov. Andrew Cuomo's
effort to hold the attention
of the people
of New York and its lawmakers continued into its second week on Monday with two more detailed presentations on elements
of his «Opportunity Agenda»:
reforms to the juvenile
justice system and the proposed creation
of a commission to decide on salary increases for lawmakers and top state officials.
The governor's unusual
effort — potentially granting mass clemency on a level rarely seen — comes as
efforts to
reform the state's juvenile
justice laws have met resistance in the Legislature; most states have raised the age
of criminal responsibility after reviewing studies that showed people are often not psychologically mature until early adulthood.
That letter — and other
efforts to reduce exclusionary discipline, such as suspensions, in favor
of reforms like restorative
justice — sparked a backlash from critics who accused the department
of government overreach and
of prompting chaos and disorder that could most harm students
of color.
I told this story to a group
of two dozen or so
of my fellow ed reformers last week at an American Enterprise Institute convening on «race, social
justice, and school
reform» because I wanted to make two simple (some will say simplistic) points: our expensive and aggressive ed
reform efforts still focus far too little on what kids do in school all day; and we don't all have the same ideas about what it means to serve the cause
of social
justice — or whether it is even appropriate to place social
justice issues at the heart
of our
efforts to improve outcomes for kids.

Given Trump's general opposition to criminal
justice reform, the antipathy among Republicans and many conservative reformers to the Black Lives Matter movement (which has championed Obama's
efforts), and the skepticism among so - called conservative reformers (most - notably Michael Petrilli
of the Thomas B. Fordham Institute and his amen corner at Education Next) on school discipline
reform, expect nothing more after January.
Meanwhile Trump's ascent into the White House bodes ill for one
of the Obama Administration's most - admirable
efforts: Holding districts accountable for overusing out -
of - school suspensions and other harsh school discipline that put poor and minority children onto the school - to - prison pipeline, an important issue both on the education and criminal
justice reform fronts.
At the present time, a small number
of studies describes how superintendents and their staffs work with state policies and regulations to ensure authentic reflection
of such
reform efforts while, at the same time, doing
justice to local district and school priorities.
In 2009, the
Justice Policy Institute noted that some states have begun to decrease the size
of the prison population — thereby reducing spending — by providing community - based substance - abuse treatment programs, increasing rehabilitation
efforts, improving parole mechanisms and services, and decriminalizing nonviolent offenses.105 States that intentionally decreased their prison populations saw crime decrease even faster than national averages.106 Other states should consider such
reforms.

I'm involved in a number
of the present
efforts to
reform family
justice.
I invite those
of you who see yourselves reflected in the list above to consider getting involved in
justice reform efforts — there are many opportunities available!

of any respectable
justice reform effort.
I fear that
efforts toward
reform which are conducted without a radical reexamination
of our fundamental assumptions about the expression
of social policy and the nature
of family
justice will produce results no better than what we have at present.

Much
of the present
efforts toward
justice reform is focused on improving public legal education, redesigning
justice processes and integrating social services within
justice processes.
Whatever is or isn't done to interrupt the slippery slope engaged by those who litigate without the benefit
of counsel, I hope that those involved in the current
justice reform efforts will consider the research undertaken by Professor Macfarlane, Justice Gray and the Ins

On a related front, last year I blogged here and here about the possibility that Chief
Justice Roberts» greatest impact could be through
efforts to expand the Supreme Court's caseload and to
reform the operation
of the cert pool.
They observe that current
reform efforts are being seriously handicapped by a paucity
of hard, empirical data about Canada's civil
justice system.
In addition to parallel legal education systems and outdated curricula, lack
of educational materials, research centers, legal clinics, and a dearth
of qualified professors have held back
efforts of legal education
reform in Afghanistan, which, if addressed, could significantly improve the
justice sector.
It also suggests strong support for our civil
justice reform efforts at the state level, where a call to action has been issued by the Conference
of Chief
Justices (CCJ) and the Conference
of State Court Administrators (COSCA) to transform our state courts to ensure access for all.
The Action Committee is focused on fostering engagement, pursuing a strategic approach to
reforms and coordinating the
efforts of all participants concerned with civil
justice.
