There are a number
of Special Enrollment Periods you need to know about.
We propose to revise paragraphs (b)(2)(i), (b)(2)(ii), (b)(2)(iv), and add paragraphs (b)(2)(v), (b)(2)(vi), and (b)(2)(vii), which pertain to effective dates for special enrollment periods; to amend paragraphs (c)(2)(i) and (c)(2)(ii), which pertain to availability and length
of special enrollment periods, and to revise paragraphs (d)(1)(ii), (d)(1)(v), (d)(2), (d)(4), and remove paragraph (d)(10), which pertain to specific types
of special enrollment periods.
Outside
of Special Enrollment Periods, Open Enrollment is the only time when you can buy health insurance throughout the year.
Commenters also suggested that improved data collection could also be used to curb possible misuse
of special enrollment periods, in addition to expanding the Exchanges» use of electronic data sources, and improving education efforts to make sure all stakeholders understand the eligibility criteria for all special enrollment periods.
Commenters appreciated the transparency of adding these special enrollment periods to regulation, so that consumers, regardless of the State in which they live, have access to the same special enrollment periods, and that all individuals involved in enrollment assistance have a better understanding
of the special enrollment periods that are available.
We believe that this certainty will contribute to greater stability in the market, and in the use
of these special enrollment periods, specifically.
State - based exchanges have some flexibility in terms
of some special enrollment periods, although CMS indicated that the special enrollment period for people whose plans are discontinued at year - end is available in every state, including state - based exchanges, regardless of whether the exchange mapped those enrollees to plans from different insurers or not.
These commenters expressed concern that some of the proposed special enrollment periods are no longer needed or that individuals who might qualify for one
of these special enrollment periods may also qualify for another special enrollment period that already exists in regulation.
We are committed to making sure that special enrollment periods are available to those who are eligible for them and equally committed to avoiding any potential misuse or abuse
of special enrollment periods.
We also appreciate the suggestions about the methods we should use to monitor special enrollment period enrollments and criteria we should evaluate in order to better understand consumer behavior and increase appropriate utilization
of special enrollment periods.
This is important to ensure that they continue to be available, are equitably applied across Exchanges, and that consumers, assisters, issuers, and other stakeholders have a common understanding of the parameters and coverage effective dates associated with
each of these special enrollment periods.
Comment: We received many comments related to amending the number and scope
of special enrollment periods.
For now, we believe that
all of the special enrollment periods currently in regulation, and those being finalized in this rulemaking, are needed.
Comment: Commenters expressed concerns about current misuse or abuse
of special enrollment periods, including consumers who inappropriately obtain a special enrollment period on the basis of a loss of minimum essential coverage after being terminated from coverage due to a failure to pay premiums in violation of § 155.420 (e)(1).
In addition, we do not anticipate that any of the amendments to the existing parameters
of special enrollment periods will reduce their availability to those individuals who should qualify under the provision's original intent.
Response: We appreciate the ideas and recommendations shared by commenters about anticipated impacts of an eligibility verification for special enrollment periods and how HHS may reduce possible misuse and abuse
of special enrollment periods, while continuing to strengthen risk pools.
In 2016, we added warnings on HealthCare.gov about inappropriate use
of special enrollment periods, eliminated special enrollment periods that are no longer needed as the Exchanges mature, and tightened eligibility rules for special enrollment periods.
We stated in the proposed rule that we had heard concerns regarding abuse
of special enrollment periods, and we sought comments and data regarding existing special enrollment periods.
Other commenters requested restrictions in the number and availability
of special enrollment periods.
In response to our request for comment and data to assess whether special enrollment periods are being abused and to minimize potential misuse and abuse
of special enrollment periods, commenters expressed strong support for the Exchange to take actions to verify consumer eligibility for special enrollment periods moving forward, including requesting documentation supporting consumers» eligibility for special enrollment periods.
Section 147.104 (b)(2)(i) extends several
of the special enrollment periods that apply to issuers on the Exchange, to all issuers in the individual market.
Comment: A commenter requested that HHS reduce the number
of special enrollment periods other than qualifying life events.
Louise Norris, a highly regarded expert on health insurance and author of our first guide, has put together an authoritative overview
of special enrollment periods and the qualifying events that trigger those SEPs.
The same open enrollment dates apply outside the exchange, and most
of the special enrollment period rules also apply to plans purchased outside the exchange.
It's important to note that HHS began ramping up enforcement
of special enrollment period eligibility in 2016, amid concerns that enforcement had previously been too lax.
Those who supported this amendment believe that this addition will help eliminate misuse and abuse
of this special enrollment period by preventing consumers from moving and enrolling in coverage only when they have health coverage needs.
In the case of a qualified individual or enrollee who is eligible for a special enrollment period as described in paragraphs (d)(4), (5), or (9) of this section, the Exchange may define the length
of the special enrollment period as appropriate based on the circumstances
of the special enrollment period, but in no event may the length
of the special enrollment period exceed 60 days.
We also considered not standardizing the availability
of the special enrollment period for Indians to non-Indian dependents enrolling at the same time as the Indian.
(iii) In the case of a qualified individual or enrollee eligible for a special enrollment period as described in paragraph (d)(4), (5), (9), (11), (12), or (13) of this section, the Exchange must ensure that coverage is effective on an appropriate date based on the circumstances
of the special enrollment period.
One commenter requested restricting the eligibility
of the special enrollment period for gaining access to new QHPs as a result of a permanent move to only consumers who were previously enrolled in other minimum essential coverage, and only allowing the new dependent to enroll in or change his or her enrollment into a new QHP under the special enrollment period described in paragraph (d)(2).
HHS also recognizes the need to communicate accurate and standard information about the availability
of a special enrollment period to consumers.
Response: We agree with commenters that adding a prior coverage requirement to the special enrollment period for a permanent move protects against misuse and abuse
of this special enrollment period by preventing consumers who are moving for the sole purpose of obtaining medical treatment from newly enrolling in a QHP.
Therefore, this technical correction would not in any way alter the parameters
of this special enrollment period.
To aid in verification
of special enrollment period eligibility, one issuer suggested implementing an online directory for issuers of consumers who have been terminated due to nonpayment of premiums.
If you experience a qualifying life event, you can take advantage
of a special enrollment period to make changes to your individual health plan or buy a new one.

special enrollment periods are the same as they were in 2017, although there's an increased focus on verifying eligibility for
special enrollment periods, so be prepared to provide proof
of your qualifying event.
