VANCOUVER — December 1 marks the last day the B.C. Liberal government could have stood up for British Columbia and stopped the federal government from ramming the proposed Enbridge pipeline and
oil tanker project through, say B.C.'s New Democrats.

oil tanker project, or we're walking.

Chandra Herbert noted that the B.C. Liberal decision to sign away B.C.'s right to say no to risky
oil pipelines and
tankers will make it more difficult to stop the
project.
The
projected threefold increase in
tanker traffic through Vancouver's harbour that will be required to accommodate the increased
oil volume poses environmental and health risks that no amount of marine response money or preparation can mitigate.
The
project is the Northern Gateway pipeline that would bring
oil from the tar sands of Alberta to a proposed
tanker terminal at the coast - an initiative supported by China, which could end up the main beneficiary of the
oil.
I oppose the Northern Gateway pipeline for a number of reasons, beginning with the fact that the
project requires over-turning the current moratorium on
oil tanker traffic on the British Columbia coastline.
Over 70 per cent of Burnaby residents are opposed to the expansion
project, which will transport more diluted bitumen between Strathcona County (near Edmonton) and Burnaby, subsequently bringing 34 additional
tankers monthly through Vancouver's Burrard Inlet and increasing the risk of catastrophic
oil spills.
The changes were requested by the
oil and gas industry in the hopes that they'd expedite the approval of
projects like
oil pipelines and
tankers, but they had an opposite effect.
The announced ban on
tanker traffic carrying crude
oil on the north coast represents an opportunity for the government to make it impossible for all practical purposes for the Northern Gateway
project to operate.
If NGP's
project is approved, approximately 225
oil and condensate - laden
tankers will travel the waters off the coast of B.C. every year and inland to Kitimat via the Douglas Channel.
For those following the Northern Gateway
project, one direction from the PM stands out: that the Ministers of Fisheries and Transportation are to formalize a moratorium on crude
oil tanker traffic on British Columbia's North Coast.
A number of First Nations have expressed serious concerns to the JRP about potential impacts to their rights from the
project due to the pipeline, increased
tanker traffic, and the risk of an
oil spill that could devastate their traditional territories, waters and resources.
West Coast Environmental Law applauds two of Vancouver's elected bodies — Vancouver City Council and the Vancouver Parks Board — for passing resolutions to take a formal position on the proposed Kinder Morgan
oil pipeline expansion
project, and associated
oil tanker traffic.
Since the recent federal election there has been much discussion (and as my colleague Eugene Kung notes, an abundance of open letters) about the Liberal party's election promise to «review Canada's environmental assessment (EA) processes and introduce new, fair processes» for reviewing
projects (or re-reviewing them, as in the case of major proposals like the controversial Kinder Morgan and Energy East
oil sands pipeline and
tankers projects).
If built, the Trans Mountain
project would dramatically increase shipments of bitumen to a maximum of about 890,000 barrels per day from Alberta to a terminal in Burnaby, a city in Metro Vancouver.The
project is also estimated to increase
oil tanker traffic by seven times above current levels in the traditional territory of the Tsleil - Waututh Nation.
Ongoing pipeline reviews: While there is a strong argument that the FCA may have applied the wrong sections of the Canadian Environmental Assessment Act, 2012 in Gitxaala (given that the Enbridge Joint Review Panel was operating under transitional rules), the analysis of the FCA is certainly applicable to more recent environmental assessments conducted by the National Energy Board — like those for the Kinder Morgan Trans Mountain and Energy East
oil tanker and pipeline
projects.
