Reforms Generating National Attention
I suspect that the real heavy lifting in enhancing access to
justice is a matter of procedural
reform — specialized decision - making bodies with extremely simplified procedural rules for specific
civil law issues (something that actually already exists in certain areas such as Landlord / Tenant, but could be further improved upon), wider permissions for over-the-counter motions, fewer unnecessary court appearances, fewer procedurally - mandated appearances (e.g., going from a Case Conference to a Settlement Conference to a Trial Management Conference, and possibly further, before you can get to a family law trial), and so
on.
«Unrealistic» plans to cut recoverable costs for the RTA portal, and extend the scheme, should be put
on hold until at least 2014 when the

reform commissions as well as self - standing initiatives such as the National Action Committee
on Access to
Justice in
Civil and Family Matters have made this sort of rethinking a priority for moving forward.
Although I'm not particularly preoccupied with legislation governing banks and corporations, I am concerned about the rules governing
civil proceedings and the law
on domestic relations, personal taxation, government benefits and criminal conduct, and it seems to me that a major goal of law and
justice reform over the next decade should be improving the accessibility of the legislation and regulations most affecting individuals.

While the Canadian
Civil Liberties Association supports the overarching goal of Bill C - 46, we view many of the suggested changes as a continuation of previous ill - advised, and at times unconstitutional, government «tough
on crime» criminal
justice reforms that would do little or nothing to combat impaired driving.
IAALS and the National Center for State Courts worked with the Arizona
