Organizations have been reckoning with an expectation of privacy
on workplace computers since the Supreme Court of Canada's 2012 finding in R v Cole.
Workplace Computers: Though employees lack privacy
on workplace computers, a recent Ontario ruling indicates that employers have no right to information on personal devices given to employees.
In a decision released on October 19, 2012, the Supreme Court of Canada («SCC») weighed in and affirmed that Canadians may reasonably expect privacy in information contained
on workplace computers where personal use is permitted or reasonably expected.
The opinion goes so far as to note that a lawyer who becomes aware that the client is receiving personal email
on a workplace computer or other device owned or controlled by the employer has a duty to warn that this practice should be discontinued.
In that decision, Richard Cole, a teacher who was responsible for monitoring the computer use of students, accessed a student e-mail account and downloaded nude photos of the student's girlfriend, saving
them on his workplace computer.
It's best to use a separate, professional email and check that email only on personal devices and not
on your workplace computer.

Where an employer permits or condones the personal use of
workplace computers, employees do have an expectation of privacy in regard to the information they may store
on the
computer.

Many employers are under the impression that they can access, copy and use any information stored
on computers provided to employees in the
