Washington — The Labor Department has postponed until Nov. 1 the enforcement of a U.S. Supreme Court decision that requires school districts to comply with the minimum - wage and
overtime provisions of the Fair Labor Standards Act.
If your job title is «manager» but you have no one reporting to you, do not have the authority to discipline, set schedules, promote, etc, then you are likely not exempt
from overtime provisions under employment standards law.
The rule's exceptions, who are exempt from
the overtime provisions regardless of how much they earn, include numerous employees of higher educational institutions, including teachers (from graduate assistants through tenured professors), coaches, and graduate and undergraduate students — but not postdocs.
With FLSs falling just outside the bargaining unit, the dispute centres around CN's treatment of FLSs as managers, thereby excluding them from
the overtime provisions of the Canada Labour Code («the Code»).
